Greenwich Police arrested a Bay Shore, N.Y., man after he crashed into a wall on Hamilton Avenue with his juvenile daughter in the back seat.

Nelson Ulises Herrera, 53, was charged with operating under the influence with a child passenger under 18 after the Aug. 23 single-vehicle collision near 10 Hamilton Ave. in the Chickahominy neighborhood, Greenwich Free Press reported.

Multiple officers responded around 8:45 p.m. to a report of a vehicle striking a wall. Police said Herrera failed standard field sobriety testing at the scene. His daughter, a juvenile, was in the back seat at the time of the crash.

Herrera faces three charges: OUI with a child passenger under 18, failure to carry an operator's license and failure to drive on the right side of the road.

The child-passenger OUI charge is the most serious. Under Connecticut General Statutes § 14-227m, a conviction carries a mandatory minimum of 30 days in jail, according to a Fairfield County defense attorney's legal reference. The statute also triggers a referral to the state Department of Children and Families, known as DCF.

Herrera's bond was set at $50,000. He could not post it.

He remained in police custody and was listed for a court appearance at Stamford Superior Court on Friday, Sept. 4. The outcome of that appearance was not available as of publication.
